Usual questions regarding the insurance
Some of the questions or elements to take into account when deciding to take out insurance for the transport of your goods.
Nothing has ever gone wrong. I have always transported my goods without insurance and I have never had any problems.
You have been lucky up to now, but remember that insurance is provided to protect you for when you are not lucky anymore. You are gambling with part of your property and your sales…a subsidence, a fire, the truck overturning or going off the road occur more frequently than we would like, even to insurance companies.
For less than you can imagine, you could be protected against these eventualities, without this type of loss affecting your income statement.
My carrier has insurance and has never had any problems.
The carrier is responsible for the goods that it transports but is exempt in several cases; force majeure, fire etc. and also has limited liability (€4.5 /kg LOTT (Spanish Law on Land Transport), and €8.33 SDR/Kg. in the CMR Convention). Furthermore, the carrier is not legally obliged to have an insurance policy, so you could be paying for insurance when there is actually no policy and if there is an accident, the carrier becomes insolvent.
I am not worried if he/you ?? does not pay his insurance. I can withhold it or deduct it from the invoice.
This measure is usual for settling small damages, but it is not legal and in the event of going to court, you would undoubtedly lose and have to pay the bill. You could also appear on a debtor’s list which would go against you when buying, selling or applying for finance.
To hold on to the customer, the carrier may consent to these reverse charges, but for how long? And what will happen when there is a major accident? You may find that the carrier does not permit this or that your balance with him is less than the amount of the accident.
The carrier’s insurance is cheaper.
Are you sure? Have you checked the figures? Take into account that I will be charging for the value of the goods and he will be charging for the value of the shipping. Many carriers make a profit on the insurance by charging more than the insurance company invoices him. IT IS NOT TRUE. Do you know exactly what cover he has taken out? And the amount insured? Do you know if the insurance policy is in effect because he has paid the invoices? Who has he taken out the insurance policy with? If the insurance company were to decline the accident, could you go against this? Would the insurance company listen to you? What power of negotiation do you have with the insurance company?
I sell the goods ex-store.
This is a good policy, but think about what would happen if the customer had not yet paid you and there was an accident. I imagine that there would be no problem if the damage was small, but if it was a major accident, there would definitely be conflict. And if the goods have not been insured? Do you know the carrier? Is he solvent? At least think about insuring these high-sum risks so that any incidents will not affect your income statement and will eliminate many arguments and expensive, long litigations.
All of my goods are insured by the seller. I buy ex-store.
You do not choose a large part of the risk that your goods are subjected to. Do you know the coverage taken out by the seller? What would happen in the event of discrepancies with the value of the damage and in the case it were declined? You would have to go to court in a foreign country with the corresponding high costs and lack of control, all the claims and problems that you have to resolve with a foreign insurance company, in their language, and for which you are not their customer.
